  1. Services Provided

UpkeepX Cleaning Services (referred to as “UpkeepX” or “we”) offers the following services:

  • Regular Cleaning (one-time, recurring maid service)
  • Move-in/out Cleaning
  • Deep Cleaning
  • Post-Renovation Cleaning

These services are for residential houses and small to medium commercial properties. We do not provide cleaning services for outdoor areas such as garages, backyards, or front yards. We only clean areas that can be reached with a standard 3-step ladder.

  1. Service Agreement

We do not have a contract that commits you to a minimum number of cleanings. You may cancel your scheduled service(s) at any time; however, a cancellation fee may apply. This Service Agreement defines the responsibilities and liabilities of UpkeepX and our customers.

  1. General Limits, Conditions, and Liability

Insurance, General Liability, Property Damage, & Tax Reporting: We carry a $1,000,000 liability insurance policy and Property Damage policy. In addition, we hereby attest to our customers that we collect and report all employer-required taxes for the cleaner’s services to local, state, and federal agencies.

Take precautions when you have any service workers in your home. It is your responsibility to keep jewelry, valuables, firearms, and lose money put away and secure. We hire honest people, conduct background checks on all employees, and train our team to work with care. However, the only way to guarantee these items are not lost, stolen, or damaged is to keep them put away and secured.

  1. Liability for Damages or Loss

We do not automatically assume liability for the loss or damage of items that are not adequately secured, stored, or functioning. Property in poor condition, including fragility, damage, or brittleness, should be appropriately identified or noted as “Do Not Clean.” In case of loss or damage to the property, the Customer must provide photographic evidence by submitting it to support@upkeepx.com or by sending a text message to (210) 591-5202. Along with the photos, the Customer must provide a brief description and any other relevant evidence that may be helpful for UpkeepX. We cannot guarantee reimbursement for damages that do not comply with the above paragraph. UpkeepX reserves the right to contract suitable professionals to repair damages and will make the payment arrangements directly with its contractors to settle any damage repair.

  1. Safety, Health Hazard & Right to Refuse Service

Our staff reserves the right to cancel or terminate the service at any time if they encounter unsafe conditions on the property. A hazardous condition is defined as any situation that poses an unreasonable hazard to the life, limb, or health of any person on the property. Examples of hazardous conditions include, but are not limited to:

  • Unsafe temperatures (should be between 68F – 75F)
  • Hazardous odors or substances
  • Unsound building structures
  • Excessive mold and mildew
  • Pest and rodent infestations
  • Exposed animal or human waste or bodily fluids

UpkeepX strictly prohibits harassment of our employees. Harassment includes, but is not limited to:

  • Controlling the course of work (micro-managing)
  • Verbal or physical abuse or assault
  • Stalking
  • Video recording or photo taking without consent
  • Invading personal space
  • Making sexual advancements, gestures, or comments

Our fees (flat-rates) are based on an Average Condition of residential premises. Average Condition means the residential premises must not be neglected, trashed, abandoned, heavily soiled, or infested with critters or bugs. Our services do not cover the following:

  • Large trash disposal
  • Excessive organizing
  • Blood or any biological contaminants such as urine, feces, or vomit of animals or humans
  • Paint on floors
  • Marks or messes on drywall
  • Anything unreachable with a step ladder
  • Rodent droppings
  • Using customer products that are unsafe, such as acids or other harsh chemicals
  • Mold behind caulking
  • Badly stained grout
  • Stains that are permanent or require harsh chemicals for removal
  • Soot in fireplaces
  • Anything outside of the home, except for some windows on patios or ground floor doors
  • Lifting glass from glass tables
  • Any item or area that could be potentially dangerous
  • Hostile work environments
  • Inside of dishwashers and washing machines & dryers
  • Indoor/outdoor grills

We will contact you to assess additional fees and/or may refuse service. Cleaners have the choice to leave upon arrival if the home is in “extreme condition” or if they feel unsafe, threatened, or disrespected by a customer. UpkeepX reserves the right to not service a property for any of the reasons listed above, and the customer will be fully subjected to our Cancellation and Rescheduling Policy. Customers are required to treat our employees with respect and professionalism.   1. Card Pre-Authorization and Payment

When you schedule a Service, we pre-authorize the full payment on the payment card 48-72 hours prior to your service date. A Service appointment will only be confirmed when the pre-authorization is successfully received. This pre-authorization will be released if the scheduled Service is canceled or at the time of final payment. We reserve the right to take the pre-authorization for the full amount of your agreed Service rate. If a payment card is declined and we cannot pre-authorize the charge within twenty-four (24) hours of your Service, the Service will automatically cancel. The card will be charged only once the service is successfully completed to your satisfaction. This payment method ensures a secure and convenient transaction process for both parties. Failure to complete the payment as specified may result in additional charges or legal action to recover outstanding fees.

  1. Cancellation and Rescheduling Policy

UpkeepX requires 72-hour advanced notice for any Service cancellations and reschedules. Cancellation and rescheduling fees are non-refundable. We understand that there are times when you must miss a Service due to emergencies or obligations for work or family. However, when you do not cancel in time, you may be preventing another customer from receiving the Service. UpkeepX reserves the right to process payments for cancellation and rescheduling fees as follows:

  1. Cancellation Fee: 
  • Cancellation on the same day of the booking incurs a 100% service fee.
  • Cancellation the day before the booking incurs a $100 fee.
  • Cancellation two days before the booking incurs a $75 fee.
  • Cancellation three days before the booking incurs a $50 fee.
  1. Rescheduling Fee: 
  • Rescheduling the day before the booking incurs a $50 fee.
  • Rescheduling two or three days before booking incurs a $35 fee.

If the service is canceled due to any reason stated under “Safety, Health Hazard & Right to Refuse Service,” a full 100% of the service fee will be charged.
Please note that all rescheduling and cancellation requests must be submitted during working hours (Monday – Friday, 9:00 AM – 6:00 PM). Any request submitted after working hours will be considered a next-day request.

  1. Frequency Discount:

In the circumstance where a client books a recurring service, receives cleaning during the initial appointment, and subsequently cancels the second appointment, the client shall be charged an amount equivalent to the one-time service price. Additionally, the client shall be responsible for the balance amount, representing the discount previously applied for the recurring service, as stipulated in the service agreement. This balance reflects the difference between the one-time service price and the discounted price originally offered for the recurring service.

  1. Refund Policy

All services are final and non-refundable, but we will be more than happy to schedule a correcting service free of charge. UpkeepX does not offer nor provide refunds or partial refunds for any of our services, including but not limited to: Standard Cleaning, Recurring Services, Move-Out/Move-In Cleans, Deep Cleans, Post-Renovation Cleans, and/or any extra services, including late-cancellation and late-rescheduling fees. You recognize and agree that you shall not be entitled to a refund for any purchase of services rendered under any circumstances.

  1. Re-Clean

Customers must report any requests and/or complaints within 24 hours of their Service. The customer must submit photographic evidence with a brief description of any missed areas, rooms, or items to support@upkeepx.com or send an SMS to (210) 592-5202. Customer requests or complaints must cover the scope of work of the selected Service as per our cleaning Checklist. Only if the request meets the scope of work of the scheduled service’s cleaning Checklist (https://upkeepx.com/check-list) will UpkeepX offer a complimentary Re-Clean.

UpkeepX is not liable to offer a complimentary re-Clean or future credits if the complaint and/or requests fall outside of the service’s scope of work as per our cleaning Checklist. UpkeepX is not liable to offer a complimentary Re-Clean or future credits if the complaint and/or requests fall outside of the Average Condition of a residential space. In addition, the following types of Service or items are not eligible for our Re-Clean guarantee:

  • Items and tasks not in our cleaning Checklist
  • Residential properties not in Average Condition
  • Residential properties without electricity or water
  • Residential properties incorrectly described or booked via our online platform, phone, or email (e.g., incorrect number of bedrooms, bathrooms, square footage, condition, etc.)

If the customer fails to contact UpkeepX within 24 hours of their services, UpkeepX will not offer a complimentary re-clean or future credits. Customers can only schedule a complimentary re-clean within 48 hours from when UpkeepX received the customer’s complaint. UpkeepX will only return for a Re-Clean within this timeframe. UpkeepX is not liable to schedule a complimentary Re-Clean past the 48-hour timeframe of the customer’s initial request.

  1. Access to Premises

Customers must provide access to the premises at the scheduled time for the cleaning service to occur. Failure to provide access may result in rescheduling or additional charges.

  1. Non-Solicitation of Our Cleaners and Employees

When entering into an agreement for services with UpkeepX, you agree not to solicit for hire any staff member introduced to you by us for any cleaning services. We spend a lot of time, money, and resources finding, interviewing, checking references and backgrounds, and training our cleaners. If you are found to have solicited one of our staff, please be advised that our referral/training fee is $3,500 per hired employee. Payment is due within 30 days from the date on the invoice. We consider our employees our most valuable asset and charge accordingly.

  1. Changes to Terms

UpkeepX reserves the right to modify these Terms and Conditions at any time. Updates will be posted on our website, and it is the customer’s responsibility to review these changes periodically.

  1. Governing Law

These Terms and Conditions are governed by the laws of the state of Texas, and any disputes will be subject to the exclusive jurisdiction of the courts in the state of Texas.
